The opinion of the court was delivered by This is an appeal in a criminal prosecution from the trial court's order overruling defendant's motion for new trial and judgment entered. Defendant was charged with the commission of the crime of robbery in the first degree under G.S. 1949, 21-527. The trial court appointed Charles W. Thompson, a regularly practicing, competent, and well-qualified attorney of Wyandotte county to represent defendant and it may be well to note here that, as reflected in the record received from both parties to this appeal, defendant was ably represented throughout the trial which lasted for the greater portion of two days.
